1. The service
These terms govern the cashing of US-dollar checks submitted through checkcashing.us. The service is provided by CHECKCASHING.US CORP, a Montana corporation (“the Provider”). By submitting an application, the applicant (“the Client”) accepts these terms.
2. Eligibility
The service is available only to the payee named on the check, acting on their own behalf, who is not a U.S. citizen or U.S. resident and who resides in a country served. Applications may be declined at the Provider’s discretion and without reasons being given.
3. Identity verification and compliance
Identity is verified, and each Client is screened against sanctions and other watchlists, under the U.S. Bank Secrecy Act. Screening continues throughout the relationship. Further information may be requested, and any transaction may be delayed, suspended or declined where due diligence cannot be completed or where required by law. Records are retained for the periods required by law.
4. The check and remote deposit
The check must be endorsed with the payee’s own signature and the words “For remote deposit only at checkcashing.us”. Clear photographs of the front and back are submitted with the application, and the check is deposited electronically from those images. The Client shall keep the original check safe for 60 days after the net proceeds are paid, produce it on request, and then destroy it. The check must not be deposited, cashed, presented or photographed into a banking application anywhere else, before or after submission.
5. Fee
A fee of 10% of the face value of the check is deducted from the proceeds. Nothing is charged upfront, and payment will never be requested in advance. Charges levied by receiving or intermediary banks, if any, are borne by the Client.
6. Payment
Net proceeds are paid in U.S. dollars by international wire to the verified account held in the Client’s own name, 14 days after the check clears (30 days for checks over USD 100,000; 60 days over USD 250,000). Clearance and payment dates are estimates and depend on third parties.
7. Returned, reversed and reclaimed checks
A check may be returned, reversed or reclaimed after it has been paid, including by the U.S. Department of the Treasury, the Internal Revenue Service, the Bureau of the Fiscal Service, a Federal Reserve Bank or any bank in the collection chain, and including reclamation under 31 U.S.C. § 3712 and 31 C.F.R. Part 240. Such action may be taken several years after payment.
If any amount relating to the Client’s check is returned, reversed, charged back, reclaimed or offset, at any time and for any reason, including presentment of the original check elsewhere, the Client shall repay on demand: (a) the full amount so returned, reversed, charged back, reclaimed or offset; (b) all bank charges, penalties and costs incurred by the Provider; and (c) all costs of recovery, including legal and collection fees. Interest accrues on any unpaid sum at 8% per year from the date of demand until payment. The fee in clause 5 is not refundable.
8. Indemnity
The Client indemnifies the Provider against all losses, liabilities, claims and costs arising from any return, reversal or reclamation described in clause 7, any forged or unauthorised endorsement, any duplicate presentment of the check, any untrue declaration or document, and any breach of these terms.
9. Recovery
Any sum demanded under clauses 7 or 8 is a debt due from the Client to the Provider. The Provider may: (a) set off that debt against any amount held for or payable to the Client, including the proceeds of any other check; (b) recover the debt, with interest and costs, through the courts of England and Wales or of any country in which the Client resides or holds assets, and the Client submits to the jurisdiction of each; (c) appoint collection agents and disclose the Client’s details to them for that purpose; and (d) report the matter to the U.S. and other authorities.
10. Client declarations
The Client declares that they are the payee named on the check and its beneficial owner; that the endorsement is their own; that the check has not been presented elsewhere and will not be; that they are entitled to the funds; and that all information and documents provided are true, complete and their own.
11. Liability
The Provider is not liable for delay or loss caused by banks, the U.S. Treasury, the Internal Revenue Service or other third parties, or by compliance with legal or regulatory obligations. The Provider’s total liability to the Client is limited to the net proceeds payable for the check concerned.
12. Personal data
Personal data is processed as described in the privacy notice.
13. Duration
Clauses 4 and 7 to 9 and 11 continue to apply for six years after the date on which the net proceeds are paid, or until any claim notified within that period has been settled, whichever is later.
14. Governing law
These terms are governed by the law of England and Wales. Each clause is severable. These terms may be amended; the version in force on the date of application applies.
